Release Form

I understand that there are inherent risks associated with training, socializing, walking, and working with dogs in general, including but not limited to risks of being bitten, scratched, knocked down, or otherwise injured, and that dogs may behave unpredictably despite reasonable precautions. I assume any and all responsibility for myself and my dog(s) during any consultation, training session, walk, or other activity involving Troubles Behind Me Canine Training, provided that due diligence and reasonable care have been exercised by Troubles Behind Me Canine Training. I will not hold Troubles Behind Me Canine Training, William Drescher, or any of their affiliates, employees, or property owners responsible for any injuries, losses, or misfortunes to or by me or my dog(s) that occur while training, walking, consulting, or engaging in any other related activity, absent gross negligence or willful misconduct on their part.

NO GUARANTEE OF RESULTS; GENERAL GUIDANCE ONLY

I understand that any consultation, discussion, written report, or verbal advice provided by Troubles Behind Me Canine Training — whether delivered online, by phone, in writing, or in person — is general educational guidance based on the information I have provided, and is not a substitute for hands-on, in-person, directly supervised instruction. I understand that dog behavior is inherently variable and that no specific outcome, improvement, or result is guaranteed. I acknowledge that if I, or any other person, choose to apply any technique, suggestion, or exercise discussed — whether during a formal training session or independently, at any other time, in any other location, without direct supervision by Troubles Behind Me Canine Training — I do so entirely at my own risk and sole discretion, and Troubles Behind Me Canine Training bears no responsibility for the outcome of, or any injury, loss, or damage arising from, that independent or improperly performed application.

NOT VETERINARY OR DIAGNOSTIC SERVICES

I understand that Troubles Behind Me Canine Training provides behavioral training and education services only, and does not provide veterinary, medical, or clinical diagnostic services of any kind. I understand that any behavioral observations shared with me are not a substitute for evaluation by a licensed veterinarian or veterinary behaviorist, and I am solely responsible for seeking appropriate medical or professional evaluation for my dog as needed.

I further understand that due to the way dogs interact with one another and with people, cuts, scratches, or other injuries can occur even when dogs are carefully supervised, and that my participation in any of these activities carries inherent risk, including but not limited to tripping, falling, being knocked down, jumped on, bitten, or scratched.

RELEASE AND INDEMNIFICATION

I hereby release, and agree to defend, indemnify, and hold harmless, Troubles Behind Me Canine Training, William Drescher, and any of their affiliates, employees, or property owners from any and all liability, claims, demands, suits, actions, losses, injuries, or damages of any nature or kind — including reasonable attorneys' fees — arising from or related to my participation, or my dog's participation, in any consultation, session, walk, or other activity with Troubles Behind Me Canine Training, or arising from any application (by me or any other person) of guidance provided in such consultation or session, whether performed correctly, incorrectly, during a session, or independently afterward. I understand that I am solely and financially responsible for any damage, injury, or harm caused by my dog during any consultation, training, boarding, socializing, walking, or other related activity, to the fullest extent permitted by law.

MINORS

If any minor is present during any session, consultation, or activity, the accompanying parent or legal guardian assumes full responsibility for the supervision and safety of that minor, and this release is signed on behalf of, and is binding upon, that minor to the fullest extent permitted by law.

PHOTO/VIDEO CONSENT

I understand that Troubles Behind Me Canine Training may, from time to time, photograph or record training sessions for training documentation, marketing, or social media purposes, and I consent to such use unless I notify Troubles Behind Me Canine Training in writing that I decline this use.

I certify that I have read, understood, and voluntarily agree to be bound by this Release Form and the Privacy Policy below. I understand that some programs are not appropriate for all dogs, and that Troubles Behind Me Canine Training reserves the right to decline, remove, or refuse any dog or client from any program, at any time, at its sole discretion.

ELECTRONIC SIGNATURE; BINDING AGREEMENT

By completing and submitting this form, I am providing my electronic signature and affirming that I have read, understood, and agree to be legally bound by this Release Form and the Privacy Policy below, to the same extent as if I had signed a physical document.

GOVERNING LAW; SEVERABILITY

This agreement shall be governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles, and any dispute shall be resolved in the courts of Berkshire County, Massachusetts. If any provision of this agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Privacy Policy

Troubles Behind Me Canine Training respects your privacy and is committed to protecting your personal information. We collect and use your information solely to manage training services, communicate with you about appointments and programs, process payments, and comply with applicable laws and regulations. We do not sell, rent, or share your personal data with third parties for their marketing purposes. Your information may be shared only with service providers or partners as necessary to deliver our services, under strict confidentiality agreements.
